
Foreclosure Defense
Our firm is representing dozens of homeowners in the foreclosure litigation process. Our team meets with each homeowner several times to analyze the facts of the case, raise every relevant and fact-based defense to the foreclosure, and communicate the client's situation to the bank to attempt an amicable resolution to the case via mediation. Our goal is to assist the client and the bank to minimize the damage caused by yet another foreclosure in our community. We will file appropriate responses in Court on behalf of the client, including Answers and Affirmative Defenses and Motions to Dismiss the Complaint, serve requests for production of documents on the bank, and attend hearings on behalf of homeowners.
Most counties in Florida now provide for pre and post-foreclosure mediation. Our attorneys and paralegals will prepare you for the mediation by meeting with you, gathering the required financial documentation, and assist with preparing the proper forms and schedules. Mediation has been a successful method for modifying mortgages in default and dismissing the foreclosure lawsuit filed against the client. Modifications can result in substantially lowered payments and potentially a principal forebearance or deferment. Our paralegals have prior work experience in the mortgage industry and intimately understand what the banks will require to modify your loan.
